About Our Services

Privacy and Security Principles: Since the inception of NatChatt, we have prioritized strong privacy and security principles in the development of our Services.

Connecting You with Others: NatChatt offers innovative ways to communicate with other users through text messages, voice and video calls, images, video sharing, status updates, and location sharing. We may also provide a platform for transferring money between users. NatChatt collaborates with partners, service providers, and affiliated companies to enhance connectivity with their services.

Service Improvements: We continuously analyze your use of NatChatt to improve our Services. This includes helping businesses measure the effectiveness and distribution of their services and messages. We utilize the information we collect and collaborate with partners and service providers for these improvements.

Business Communication: NatChatt enhances communication between users and businesses through our Services, facilitating order, transaction, and appointment information, delivery notifications, product updates, and marketing.

Safety, Security, and Integrity: We are committed to protecting the safety, security, and integrity of our Services. This includes addressing abusive behavior, misuse, and violations of our Terms. We take appropriate actions, including removing violative content or users and, if necessary, contacting law enforcement. Any removal will follow the “Termination” section.

Global Service Access: To provide our global Services, we store and distribute content and information in data centers around the world, including outside your country of residence. This global infrastructure is essential to our Services and may be managed by our service providers and affiliated companies.

Affiliated Companies: As part of NatChatt Ltd., we share and receive information with our affiliated companies to provide integrations, ensure security, and improve your experience across NatChatt and other affiliated products.
No Access to Emergency Services: Unlike traditional mobile phones or fixed-line telephones, NatChatt does not provide access to emergency services such as police, fire departments, or hospitals. You should ensure that you can contact emergency services through alternative means.

Special Arbitration Provision for United States or Canada Users: Our Terms include a binding arbitration provision for users in the United States and Canada, requiring individual arbitration for most disputes and waiving the right to participate in class actions. Please read the "Special Arbitration Provision for United States or Canada Users" section for more details.

Registration: You must register with accurate information, provide your current mobile phone number, and update it as necessary. You agree to receive text messages and phone calls for verification purposes.

Address Book: You can upload your contacts to NatChatt, providing phone numbers from your mobile address book, subject to applicable laws.

Age Requirement: You must be at least 13 years old to use NatChatt. If you are under the legal age to agree to our Terms in your country, a parent or guardian must agree to our Terms on your behalf.

Devices and Software: You need certain devices, software, and data connections to use our Services. You consent to the automatic or manual download of updates and notifications necessary for our Services.

Fees and Taxes: You are responsible for data plans, internet fees, and other charges associated with using our Services.

Privacy Policy and User Data

Privacy: NatChatt cares about your privacy. Our Privacy Policy describes our data practices, including the types of information we collect, how we use and share it, and your rights.

Harm Prevention: You must not harm NatChatt or its users by reverse engineering, distributing viruses, gaining unauthorized access, interfering with services, or any other harmful actions.

Account Security: You are responsible for keeping your NatChatt account and device secure. Promptly notify us of any unauthorized use or security breaches.

Third-Party Services

Third-Party Interactions: NatChatt may allow interactions with third-party websites, apps, content, and services. Our Terms and Privacy Policy apply only to our Services. Third-party terms and policies govern your use of their products and services.

Licenses

Your Rights: NatChatt does not claim ownership of the information you submit through our Services. You must have the rights to the information you submit and grant us the necessary licenses to operate our Services.

NatChatt’s Rights: We own all intellectual property rights associated with our Services. You may not use our intellectual property without our permission.

Your License to NatChatt: You grant NatChatt a license to use, reproduce, distribute, and display the content you upload, submit, or receive through our Services. This license is for the purpose of operating and providing our Services.

NatChatt’s License to You: We grant you a limited license to use our Services as permitted by our Terms.

Reporting Third-Party Infringement

Disclaimers and Limitation of Liability

Disclaimers: NatChatt provides Services "as is" without warranties. We are not responsible for how users interact with our Services or the information provided.

Limitation of Liability: NatChatt’s liability is limited. We are not liable for indirect or consequential damages. Our aggregate liability will not exceed $100 or the amount you paid us in the past twelve months.

Indemnification

Indemnity: You agree to indemnify NatChatt for claims arising from your use of our Services, your breach of our Terms, or any misrepresentation made by you.

Dispute Resolution

Governing Law: The laws of the State of California govern our Terms and any disputes.

Time Limit: You must bring any claims within one year of the dispute arising.

Arbitration for U.S. or Canada Users: Disputes with U.S. or Canada users will be resolved through binding arbitration, except for intellectual property disputes and small claims court cases.

Termination and Availability of Services

Service Availability: NatChatt may modify, suspend, or terminate services at any time. Events beyond our control may affect service availability. Termination: We may terminate your access for violating our Terms or creating harm. Certain provisions will survive termination.

Other Provisions

Entire Agreement: These Terms constitute the entire agreement between you and NatChatt.

Export Laws: You must comply with all applicable export control and trade sanctions laws.

Language: These Terms are written in English. Translated versions are for convenience only.

Amendments: We may update these Terms and will notify you of material changes.

Assignment: NatChatt may assign its rights and obligations under these Terms.

Feedback: We appreciate feedback but have no obligation to compensate for it.

Special Arbitration Provision for United States or Canada Users

Arbitration Agreement: U.S. and Canada users agree to binding individual arbitration for most disputes, waiving the right to participate in class actions.

Opt-Out Procedure: Users can opt out of arbitration within 30 days of accepting the Terms.

Small Claims Court: Users can bring disputes in small claims court if permitted by local rules.

No Class Actions: U.S. and Canada users waive the right to participate in class actions.

Place for Permitted Court Actions: If arbitration is unenforceable, disputes will be resolved in the United States District Court for the Northern District of California or a state court in San Mateo County, California.

Accessing NatChatt’s Terms in Different Languages

Language Settings: Access our Terms in different languages by changing your NatChatt session language. If not available, the English version prevails.
